Guantanamo Bay is to some extent unique. It is a subcategory of the delimitation of particular spaces as having a different role in the legal order. The US judicial system is now wrestling with the question of what kind of constitutional rights someone has who is held in a military base under the war powers - a territory under United States legal jurisidiction, but in which civil rights do not apply. Guantanamo is in a sense the extreme of such an extraterritorial space as it is not even in the country although it is under the control of the country.
